BOOKING TERMS AND CONDITIONS

Reservations for short term holiday accommodation are accepted by Seaside Holiday Home Accommodation (ABN 38 237 640 938) of PO Box 278, Floreat WA 6014 (“the Booking Agent”) as agent for the Owner of the Property and to which bookings the following terms and conditions shall apply:

COVID:

CANCELLATION - Domestic Cancellation due to Coronavirus Travel Restrictions (applicable to the Guest Name / Address on the booking):

Where a guest cancels due to travel restrictions that are either not removed as expected, extended, imposed or reimposed, the guest will be offered a credit note (to be used within 12 months), where such an offer is at the absolute discretion of Seaside Homes. Seaside Homes reserves the right to withhold a $200 administrative expense, dependent on when notice of cancellation is given by the guest.

INTERSTATE GUESTS:

The guest shall comply with all Government (Federal and State) COVID-19 vaccination or testing requirements for entry into Western Australia. Where the guest does not meet a vaccination or testing requirement prior to departure from the guest’s home location, the guest will forfeit any and all monies paid.

INTERNATIONAL GUESTS - Due to Coronavirus Travel Restrictions:

We will accept bookings from International travellers for stays from February 5th, 2022, unless you hold an exemption to enter Australia. We will continue to review this date as travel / border restrictions are updated.


RENTAL CONTRACT:

The Guest declares that he/she is over 21 years of age, and no Guest under the age of 21 is permitted to occupy the Property unless accompanied by an adult. The rental contract is between the Guest and the Owner of the Property for which the accommodation booking is made and is subject to the terms and conditions herein. The contract for accommodation shall not be effective until the Booking Agent sends the Guest written confirmation of the booking. The Guest acknowledges that the Booking Agent acts as a booking agent for the Owner and not as a principal. The house is available to the Guest for vacation purposes only for the period stated on the Booking Form and Guests are not permitted to host parties or functions of any kind while staying at the Property, and noise levels after 11:30pm to be kept to a minimum out of respect for neighbouring properties. Amplified music shall not be played outside of the house between 10pm and 10am. We do not have the resources, policies and procedures in place for Schoolies bookings and therefore they cannot be accepted under any circumstances. Sorry no pets allowed, unless prior arrangement is made at time of booking.

DEPOSIT:

The accommodation booking will not be confirmed by the Booking Agent until the Guest’s deposit payment is received and cleared. If the accommodation booking is made within six (6) weeks of the date of commencement of the Guest’s proposed holiday, the full rental payable for the Property is required together with any bond, credit card information and any other payments applicable.

GUEST PRE CHECK IN / SECURITY BOND PAYMENT:

A Guest Pre Check-In form is required to be completed for all bookings. The Pre Check-In form requests details of your name, address, drivers licence number as well as credit card details authorised to be debited in the event of damage or any other incidental charges that may be incurred by the guest as per our Terms and Conditions. If credit card details cannot be supplied a $500.00 bond is payable by EFT transfer. The bond balance will be returned by EFT transfer within 14 days of your departure date. An increased bond may be incurred for group bookings or at our discretion.

BOOKING CONFIRMATION:

Once a Guest’s booking has been confirmed, the Guest shall be responsible for payment of the total price for the rental period and all extras (if any) as shown on the confirmation notice on or before the dates or dates referred to in such notice. The Guest is required to complete and return a Guest Pre Check-In form, including nomination of credit card details to be debited in the event of incidentals or damage being incurred by the guest at the property, before details such as the key etc will be released. It is the Guests responsibility to ensure they have completed the Guest Pre Check-In form and details regarding their stay have been received before the arrival date of their stay. No refund of monies is payable if Guest arrives at destination or Property without confirmation details, and/or leaves a phone or email message after office hours.

FINAL PAYMENT:

The full amount payable in respect of the Property rental shall be paid at least six (6) weeks prior to the date of commencement of the booking or as specified on the Application form. If the full payment has not been received by the Booking Agent at least twenty eight (28) days prior to the start of the rental period, then the Booking Agent and the Owner reserve the right to cancel the booking without notice and the Guest will forfeit the Guest’s deposit which will be non-refundable in such circumstances.

CANCELLATION - Standard:

Deposit is non-refundable under all circumstances. If written cancellation is received by the Booking Agent before the final balance of tariff is due, the Guest will be released from the liability for the full balance. Consideration may be given to allow the guest to transfer the booking (of the same house only) to another date, plus transfer fee of $200. Where written notification of a cancellation is received after the full balance has been receipted and confirmed, the property is reserved for the Guest for the specified period whether or not occupation of the Property occurs; if a replacement booking is found 20% of the tariff will be retained. The Booking Agent recommends that the Guest take out comprehensive holiday cancellation and protection insurance with a reputable company to cater for any unforeseen circumstances (see “Insurance”). Where the Guest chooses to shorten their stay or reduce the number of guests in the booking, a refund, credit or transfer is not available for any unused portion of the booking.

GROUP SIZE:

The Guest may only allow the Property to be occupied by the number of persons nominated in the Guests application and under no circumstances shall the number of people occupying the Property be greater than the number of beds provided, or that appearing on the Guest’s application or the booking confirmation whichever is the lesser. (Each person over the age of twelve (12) months is to be accounted for in the total number of persons occupying the Property). The Booking Agent and Owner reserve the right to refuse occupation of the Property to the Guest if the condition on the number of people intended to occupy the Property is not observed. Shire regulations allow holiday homes to be rented for accommodation purposes only and not as a function venue eg. for a wedding or party. Functions and gatherings are not permitted and, if evidenced, may be closed down immediately and result in the forfeiture of remaining night’s accommodation in full. Strictly No Camping Allowed policy applies to the Property. This includes sleeping bags, mattresses, tents, campervans, caravans, and more cars than the Property accommodates.

NOISE & NEIGHBOURS

We want you to enjoy your stay but please be aware of the impact of your noise on others and keeping our neighbours happy is of paramount importance. Noise and music should not impact any other property and noise levels are to be respectful at all times. There is to be no outdoor music or outdoor entertaining after 10pm. Noise complaints will result in $350 penalties and possible eviction.

ARRIVAL & DEPARTURE TIMES:

Check-in time is strictly from 3:00pm (or as advised) and departure is before 10:00am (or as advised) due to limited amount of time for cleaning, inspection and maintenance required between bookings. Unless otherwise arranged, a fee of $70 will be applied for each hour that guests remain on premises. This late checkout fee will be deducted from the authorised credit card on the Booking Form or Security Bond payment.

INSURANCE:

The Booking Agent recommends that the Guest takes out comprehensive holiday cancellation and protection insurance with a reputable company to cater for any unforeseen circumstances which may arise including accident, ill health or any other matters beyond the Guest’s reasonable control, as once the booking has been made and confirmed, the Guest will be responsible for payment of the full rental whether or not occupation of the Property occurs.

GUESTS PROPERTY:

All personal belongings, baggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and neither the Booking Agent nor the Owner shall accept any responsibility for any injury, loss or damage thereto.

LOST PROPERTY

Personal belongings left at a property can be returned to a nominated address, a postage & handling fee of $50.00 will be charged to your credit card. If our guest services team find lost property at a holiday home, we will hold the items for a maximum of one month.

RIGHT TO REFUSE OR REVOKE BOOKINGS:

The Booking Agent and the Owner reserve the right to revoke or refuse to honour any property accommodation booking which may in the opinion of either party (and at their sole discretion) be unsuitable for the Property concerned.

GUEST’S OBLIGATION IN RESPECT OF THE PROPERTY:

The Guest shall be responsible for the Property during the Guest’s stay. The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property including all utensils, fixtures, fittings and equipment on, in or about the Property in a clean and tidy condition. It is the Guest’s responsibility to clean the BBQ. All damages, breakages or losses to the property, furniture and furnishing are to be reported to the Booking Agent and paid for by the Guest immediately. Should a fault or breakage be discovered on arrival at the Property, please advise us/or leave a message or we will consider those the responsibility of the current Guest and charge accordingly. Funds will be deducted from the Guest's credit card or Security Deposit if we need to make a claim which may include, but is not limited to, the following: excess cleaning fees @ $100p/hr, damage or breakages, excess garbage removal, late check out, locksmith fees. When the total amount claimed for damages exceeds $150.00, an Agents fee starting from $50.00 applies to cover time and expenses. The Guest shall observe the No Smoking Inside requirement for the duration of stay.

REPRESENTATIONS:

The Guest acknowledges that the Booking Agent has used its best endeavours to describe the Property to the Guest within the limited extent of the communication between the Guest and the Booking Agent and the Booking Agent shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever.

DESCRIPTION OF THE PROPERTY:

All information in respect of the Property contained in the Booking Agent’s website is believed to be correct at the time of the publication, however, all details are subject to change by the Booking Agent and/the Owner without notice. The Booking Agent will not accept any responsibility for any alterations to the Property or any part thereof beyond the Booking Agents control or any liability for any matter or occurrences beyond the Booking Agents reasonable control including damage caused by extreme weather conditions, break down of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.

AVAILABILITY OF PROPERTY:

The short term accommodation contract negotiated by the Booking Agent and made between the Guest and the Owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest. Should any events whatsoever arise beyond the reasonable control of the Booking Agent such as the Property is being sold, or which render the Property uninhabitable (for example flood, fire, storm, tempest, etc) then the Booking Agent may have to cancel the Guest’s booking for the Property. Should such circumstances arise then the Booking Agent will endeavour to relocate the Guest to a holiday home of similar standard to the Property in the same area. Where this is not possible, the Booking Agent will refund all monies paid by the Guest in respect of the Property. Upon refund of the monies paid, the guest shall have no further claims whatsoever against the Owner of the Property or the Booking Agent.

PET BOOKING TERMS AND CONDITIONS:
Confirmation of a booking and payment of a deposit means acceptance of the terms below.
Pets are only permitted at pet-friendly properties with the prior consent of Seaside Homes and the property Owners.

An additional accommodation charge or pet fee will be applied at the time of booking.

The following must be adhered to:

Pets are to be kept under control at all times.

Pets must not be left unsupervised or alone at the property at any time. Property neighbours may call the local ranger if the dog is barking.

The Guest is responsible for any damage caused by pets, inside or outside the property. If extra cleaning is required this will be deducted from the Security Bond.

Pets are not permitted into bedrooms or on the furniture at any time. Charges will apply for cleaning of furniture/ bedding where applicable.

Pets that are allowed inside should be cleaned and fully dried off before being allowed to enter the property.

Guests agree to bring their own pet bedding, food bowls and other pet items to the property as, unless specified, these items will not be available at the property.

Guests must dispose of pet faeces and this is to be done in a clean and sanitary manner.

Additional pet restrictions may apply at some properties, these will be noted in the property features. Neither Seaside Homes nor Property Owners can accept responsibility for pet safety nor do we guarantee the suitability of the property for the dog you are bringing. The onus is on the pet owner to ensure that the property is suitable for their pet.
